Steps:
1) Open LO
2) Open the paragraph style editor for Heading 9 and Heading 10
3) Both will mention on the Organizer tab under the Contains heading - Western text: 75% + bold + Numbering(Outline) + X + Indent left 0.0 inch, Indent right 0.0 inch + From top 0.04, From bottom 0.04 inch

If you compare heading 5 and 6, as well as 7 and 8, the difference between each is that the second heading also has italics.

Agree, the Heading 10 style should probably have been set Italic

Think this is a simple toggle in /sw/source/core/doc/DocumentStylePoolManager.cxx; toggle the false at 564 to true.
